Clients sometimes
get into trouble with councils and need help defending themselves
against enforcement action. Our development professionals are
familiar with all legal and procedural issues surrounding enforcement
action having worked in local government themselves.
We generally seek to resolve situations on behalf of our clients
through negotiations and have good working relationships with
local authority enforcement officers. However, we can also defend
our clients at enforcement appeals and source expert legal advice,
if required. We recently obtained retrospective planning permission
and listed building consent for an extensive range of outbuildings
within the grounds of a listed farmhouse located in the Bedfordshire
Green Belt.
4 Acre Nursery – Aylesbury
Vale. Our client purchased this old horticultural nursery site
back in the 1980’s. In addition to the few plants that were
cultivated at the site he commenced the manufacture of garden
paving slabs, timber products such as fence panels and also stored
and supplied building materials such as sand and gravel etc.
In 2004 the business had developed to a scale where it was brought
to the attention of the Councils Enforcement Officer. We received
instruction to represent the client and seek to negotiate a solution
with them so as to prevent enforcement proceedings being taken.
Despite the sites countryside and somewhat remote location we
secured a retrospective planning permission for the site uses
and a number of unauthorised buildings to enable the business
to continue and grow.
